Appeal Court upholds Adeleke as winner of Osun governorship election

The Court of Appeal in Abuja has upheld the election of Governor Ademola Adeleke of Osun State.

A three-member panel of justices presided by Mohammed Lawal Shuaibu on Friday held that the All Progressives Congress (APC) candidate and former governor, Gboyega Oyetola failed to prove allegations of over-voting against the Peoples Democratic Party (PDP).

In the unanimous verdict, the appellate court also awarded N500,000 cost against the APC and its candidate.

The panel, however, dismissed Adeleke’s contention that the comments by the chairman of the governorship election petitions tribunal saying about “go low low, Buga won” did amount to bias.

The Osun Governorship Election Petition Tribunal in January held that Oyetola was able to prove that there was over-voting in some of the polling units.

Consequently, the majority judgment of the Tribunal ordered INEC to withdraw the certificate of return issued to Adeleke and issue a fresh one to Oyetola as the duly elected governor of Osun instead.
